Notice of Privacy Practices

Effective September 1, 2026. This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Our commitment to your privacy

Here at Home Healthcare ("HAHH," "we," "us," or "our") is committed to protecting the privacy of your health information. We are required by law to keep your protected health information ("PHI") private and secure; give you this Notice of our legal duties and privacy practices regarding your health information; follow the terms of the Notice currently in effect; and notify you if a breach occurs that may have compromised the privacy or security of your health information.

"Protected health information" means information that identifies you, or could reasonably be used to identify you, and relates to your past, present, or future physical or mental health, the care we provide you, or payment for that care. This includes the information in your care plan, assessment, shift notes, scheduling records, and communications about your care.

How we may use and disclose your health information

We use and disclose your health information for the following routine purposes without needing your written authorization:

For treatment and your care

We use your health information to plan and provide your in-home care and to coordinate among the people involved in it. For example, we share relevant information with the caregivers assigned to you so they can follow your care plan and your preferences, and we may share information with your physician, other providers, or family members involved in your care, as appropriate.

For payment

We use and disclose your health information to bill and collect payment for the services we provide. For example, if you use long-term care insurance, we may share information with your insurer to verify coverage and obtain payment for your care.

For health care operations

We use your health information to run our agency and improve the quality of care. For example: caregiver scheduling and supervision, training, quality review, care-plan review, internal complaint handling, and general administrative functions.

Other uses and disclosures we may make without your authorization

We may use or disclose your health information without your authorization in the following circumstances, as permitted or required by law:

Permitted by law

As required by law, when federal, state, or local law requires it
To report abuse, neglect, or domestic violence, including our duty as mandated reporters under the Missouri Adult Abuse and Neglect Reporting Act and related laws
For public health activities, for example reporting to public health authorities to prevent or control disease
For health oversight activities, for example audits, investigations, and inspections by oversight agencies
For judicial and administrative proceedings, in response to a court order, subpoena, or other lawful process
For law enforcement purposes, in limited circumstances permitted by law
To coroners, medical examiners, and funeral directors, as necessary for them to carry out their duties
To avert a serious threat to health or safety, to prevent or lessen a serious and imminent threat to you or others
For workers' compensation, as authorized by and to the extent necessary to comply with workers' compensation laws
For specialized government functions, for example military, national security, or correctional purposes, where applicable

Uses and disclosures that require your written authorization

Other uses and disclosures of your health information, including most marketing communications, any sale of your health information, and disclosures not described in this Notice, will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it. To revoke, contact our Privacy Officer using the contact information below.

We will use or disclose only the minimum amount of health information necessary for the purpose, except when sharing for treatment.

Your rights regarding your health information

You have the following rights regarding the health information we maintain about you. To exercise any of these rights, contact our Privacy Officer in writing at the address below.

Your rights

Inspect and copy: request to inspect and receive a copy of the health information we use to make decisions about your care; we may charge a reasonable, cost-based fee for copies and will respond within the time the law allows
Request an amendment: if you believe your health information is incorrect or incomplete, you may request that we amend it; we may deny your request in certain cases and will explain why in writing
An accounting of disclosures: request a list of certain disclosures we have made, other than those for treatment, payment, health care operations, and certain other excepted disclosures
Request restrictions: ask us to limit how we use or disclose your health information; we are not required to agree to every request, but we will consider it, and we will honor the paid-in-full out-of-pocket restriction where the law requires
Confidential communications: ask us to communicate with you in a specific way or at a specific location, for example by a particular phone number; we accommodate reasonable requests
A paper copy of this Notice: request a paper copy at any time, even if you agreed to receive it electronically
Be notified of a breach: you have the right to be notified if a breach occurs that may have compromised the privacy or security of your health information

Our duties

We are required by law to maintain the privacy and security of your health information, to provide you this Notice of our legal duties and privacy practices, to follow the terms of the Notice currently in effect, and to notify you following a breach of unsecured health information.

Changes to this Notice

We reserve the right to change this Notice and to make the revised Notice effective for health information we already have as well as any we receive in the future. The current Notice is posted on this page and provided to active clients, and shows its effective date. You may request a copy of the current Notice at any time.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us by contacting our Privacy Officer. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights: 200 Independence Avenue, S.W., Washington, D.C. 20201, 1-877-696-6775, www.hhs.gov/ocr/privacy/hipaa/complaints/.

We will not retaliate against you for filing a complaint.
